1. General

This agreement governs your use of the Tour Me On app and website. By using the Service, you explicitly and implicitly agree to be bound by these Terms each time you use them.

Tour Me On may modify or discontinue any part of the Service at any time, with or without notice, and is not liable to you or any third party for any such change, suspension, or discontinuation.

2. Our Services

Tour Me On provides audio-guided self-paced city tours, points of interest, maps, and offline access to its content via a mobile application and website.

Some content is offered free of charge as a preview; full access to a city guide requires a one-time purchase processed through Apple App Store, Google Play, or RevenueCat web checkout.

3. Account Registration

Account registration is optional. You may browse and preview content without an account, but a registered account is required to download city guides for offline use, restore purchases, and synchronise progress across devices.

By registering, you represent that the information you provide is truthful, accurate, and complete, and that you will keep it up to date.

Tour Me On may suspend or terminate your account at any time, without notice, if you violate these Terms or otherwise misuse the Service.

4. Intellectual Property

All materials made available through the Service — including text, audio recordings, narrations, images, photographs, illustrations, maps, logos, trademarks, and software — are owned by, controlled by, or licensed to Tour Me On and are protected by copyright, trademark, and other intellectual property laws.

Nothing in the Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any intellectual property displayed in the Service without the prior written permission of Tour Me On or the respective rights holder.

5. Content Disclaimer

The information and materials contained in the Service are provided for your reference only. Tour Me On does not guarantee that the content is complete, accurate, current, or that points of interest are open, accessible, or operating as described.

You are responsible for verifying opening hours, accessibility, ticket prices, and safety conditions locally before making any travel decisions. Tour Me On shall have no responsibility or liability of any kind for any decisions you make based on information received through the Service.

6. No Warranties; Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. Tour Me On disclaims all implied warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, the aggregate liability of Tour Me On for any claim arising out of or relating to the Service shall not exceed the amount you paid for the affected city guide in the twelve (12) months preceding the claim, or €10 if no such payment was made.

Nothing in these Terms limits any liability that cannot be limited under applicable consumer protection law.

7. Rules of Conduct

You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. In particular, you agree not to:

• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service or its underlying audio assets.

• Copy, republish, redistribute, sell, or sublicense any audio guides or other content from the Service.

• Bypass, disable, or interfere with any purchase gates, authentication, or other security mechanisms.

• Use any automated scripts, scrapers, or crawlers to access the Service.

• Stalk, harass, abuse, or harvest contact information of other users.

• Use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

8. Purchases and Refunds

All purchases of city guides are processed by the platform you bought them on: Apple App Store, Google Play, or RevenueCat web checkout. Tour Me On does not directly receive or store your payment details.

Refund requests are subject to the policy of the platform that processed your payment. Tour Me On cannot directly refund purchases made through Apple, Google, or Stripe; please contact the relevant platform for refund support.

Once a city guide has been unlocked on your account, the corresponding entitlement is tied to that account and may be restored on any device using the "Restore purchases" function.

9. Governing Law and Disputes

These Terms are governed by the laws of the European Union member state in which you reside, where mandatory consumer protection rules so require, and otherwise by the general principles of European Union law, including the General Data Protection Regulation (GDPR).

Nothing in these Terms limits or excludes any non-waivable rights granted to you as a consumer by applicable EU or local law.

No exclusive forum is designated. Any dispute will be resolved before the competent courts under applicable law, including, where available, online dispute resolution mechanisms provided by the European Commission.

10. Changes and Contact

Tour Me On may, at any time and without prior notice, change these Terms by posting an updated version with a new "Last updated" date. Your continued use of the Service after any such change constitutes your acceptance of the updated Terms.
